Suisse: l'islamologue Tariq Ramadan définitivement condamné pour viol
Switzerland's highest judicial authority announced Thursday that Tariq Ramadan had been sentenced to three years in prison, including one year in prison, for rape. However, the Islamic scholar's lawyers announced that he would appeal to the European Court of Human Rights (ECHR).
The Swiss Federal Court announced on Thursday that it had rejected Mr. Ramadan's appeal against his conviction "for rape and sexual coercion handed down by the Geneva Court of Justice" last year, for acts dating back 17 years.
This is his first conviction for rape.
Mr. Ramadan, 63, is due to go on trial in France next March for the rape of three women between 2009 and 2016, a case emblematic of the #MeToo era. He disputes the accusations.
In Switzerland, the Geneva courts acquitted him at first instance, before convicting him on appeal in 2024. A conviction confirmed by the Federal Court.
"The defense acknowledges the Federal Court's decision and challenges it. (...) This judicial truth in no way undermines the truth maintained by Mr. Ramadan, even if it does not enshrine it," his lawyers, Yaël Hayat and Guerric Canonica, said in a statement sent to AFP.
"The final word will now rest with the European Court of Human Rights," they said.
During the trial, Tariq Ramadan, a charismatic and controversial figure in European Islam, denied any sexual acts and pleaded for acquittal.
For the plaintiff's lawyers, Véronique Fontana, François Zimeray and Robert Assaël, the Federal Court's decision marks "the end of a long ordeal and a long legal battle for our client and her lawyers."
"She fought this fight discreetly and without hatred, with exceptional dignity," they said in a message sent to AFP.
The facts date back to 2008.
A convert to Islam, the complainant, "Brigitte," who goes by this name to protect herself from threats, filed a complaint ten years after the events, encouraged by complaints filed by women in France in 2017 against the Islamic scholar.
During the two trials in Geneva, she recounted how he subjected her to brutal sexual acts accompanied by beatings and insults in the room of the Geneva hotel where he was staying, on the night of October 28, 2008.
The two protagonists had explained that they had spent the night together. But Mr. Ramadan had claimed to have allowed himself to be kissed before ending the exchange and accused the complainant of wanting revenge.
In its judgment, the Federal Court emphasizes that the Geneva Court of Justice "based its verdict on several testimonies, certificates, medical notes and opinions of private experts which, according to it, were consistent with the facts reported by the victim."
"Nothing in the appeal brief makes the conclusion" of the Geneva cantonal court concerning "serious events of a sexual nature" untenable," the federal judges explained in the ruling.
They also indicate that "if the complaint had been based on slanderous denunciation, the increase in post-traumatic elements", as noted by psychiatrists, "would not have been observed", and consider that, moreover, "the respondent did not derive any secondary benefit from her accusations".
The Federal Court further emphasizes that Mr. Ramadan "fails to demonstrate the arbitrariness in the assessment" made by the Geneva courts "of the witness statements and medical findings concerning in particular the state in which the respondent was in the days following the alleged facts."
Finally, he also indicates that there was "no violation of the presumption of innocence by the cantonal court."

Condamné définitivement par un juge " sous emprise " sioniste, cela ne veut rien dire pour nous. Tariq Ramadan est aujourd'hui plus propre et plus saint pour nous. Il y a longtemps que nous avons compris que quand quelqu'un a en face de lui le sionisme et ses médias, cela suffit comme preuve que toute accusation contre lui est fausse, que toute condamnation contre lui est pilotée depuis Israël.
Et depuis le départ du et des dossiers à vouloir faire de Tariq Ramadan un violeur, il y a la journaliste française agent d'Israël, lesbienne vivant en couplé avec une autre femme, Catherine Fourest. Nous, c'est au point de départ que nous avons compris, pas à la fausse condamnation définitive.
