In a decision made public this Friday, the Supreme Court authorized the prompt service of the interim relief application filed by Barthélémy Dias, challenging his removal from office as a municipal councilor in Dakar. This interim relief will be heard on Monday, the very day the new mayor of the Senegalese capital is elected. Although the Court did not suspend the electoral process, several experts believe that this hearing could influence the outcome of the vote.

Interviewed by L'Observateur, lawyer El Amath Thiam points out that the interim relief judge rules alone and without delay, and can immediately suspend an administrative decision if the legal conditions are met. "If the suspension is granted, the act ceases to have effect. Otherwise, it remains applicable."
The source for the daily newspaper of the Future Media Group also emphasizes that the orders issued in this context are final and cannot be appealed.
For his part, electoral expert Ndiaga Sylla believes that the coincidence between the date of the interim hearing and that of the municipal election poses a problem. "Out of republican elegance and respect for the spirit of the texts, the municipal session should be postponed," he suggests.
