The legal battle over Dakar's mayoralty is intensifying. On Monday, August 25, 2025, while the election of a new mayor is underway, the lawyers of former mayor Barthélémy Dias, declared to have resigned by the Dakar prefect, filed a motion for interim relief before the Supreme Court to block the convening of the municipal council. On December 11, 2024, the Dakar prefect announced Barthélémy Dias's resignation from his position as municipal councilor, citing his ineligibility following his final conviction in the Ndiaga Diouf case.
On this basis, he demanded an urgent meeting of the municipal council on August 25 to elect a new mayor. Dias' lawyers point out that an appeal for abuse of power against this decision is already pending before the Supreme Court, with a hearing set for September 18, 2025. They consider it illegal and premature to organize an election before this date. In his plea, Alioune Badara Fall denounced an abuse of power by the prefect, arguing that only the Presidency of the Republic, after consulting the Minister of Local Authorities, can dismiss a mayor, in accordance with an adversarial procedure.
He pointed to a lack of legal basis and a misuse of procedure, with the prefect relying on inapplicable provisions of the electoral code. "The urgency is evident with the hasty convening of the municipal council, and there is serious doubt about the legality of the decision. The mayor cannot be replaced by a simple extraordinary assembly," he insisted. For his part, El Hadji Diouf denounced an attack on Senegalese democracy, accusing the regime of denigrating the justice system. El Hadji Amadou Sall considered that the objective was to discredit the institutions.
In defense, the State Judicial Agent, Mr. Bouna Diakhaté, ruled the application inadmissible. Mr. Ousseynou Ngom requested its dismissal, while Mr. Khady Camara denounced the proceedings as lacking seriousness. Mr. Étienne Dione recalled that the stay of execution no longer exists, and Mr. Khadim Kébé argued that the interim relief judge is the one for emergencies, adding that doubt about the validity of the decision had not been established.
The Attorney General, in his submissions, also requested the dismissal of the application, stating: "We are not before the judge of legality, but before the interim relief judge."
He ruled that the urgency had not been demonstrated and that the applicant had not proven sufficiently serious harm. On legality, he added: "The mayor is first and foremost a municipal councilor. Losing this status automatically entails the loss of the mayor's mandate. I see no serious doubt about the prefect's decision."
The case has been adjourned for further consideration, with a decision expected this Monday at 12 p.m.
