Affaire ASER-AEE POWER : Le parti RV dénonce l'"étrange entrée en action" de la Cour Suprême
Réewum Ngor (RV), led by Thierno Alassane Sall, has publicly expressed concern about the latest legal development in the ASER (Senegalese Rural Electrification Agency) v. AEE Power EPC case. The party denounces "a strange intervention by the Supreme Court."
The RV party recalls that the Supreme Court had been seized of an appeal for abuse of power since October 21, 2024. However, it is curious to note the "sudden awakening" of the Court to register the case this Wednesday, December 17, even though the Research Section, on the instruction of the Financial Judicial Pool, is currently conducting investigations and is preparing to summon the administrative authorities involved.
For the party, the activation of the Court in this context "can only be worrying".
The Disregard for the Jurisdiction of the Chambers
The RV's concern is heightened by the unusual handling of the case. The party emphasizes that an appeal for abuse of power is an "administrative matter" that falls under the jurisdiction of the administrative courts. Yet, the First President of the highest court has "strangely assigned the case to the Second Civil and Commercial Chamber," which has absolutely no jurisdiction over appeals in administrative matters.
According to the RV, "as if by pure chance", the president of this Second Civil and Commercial Chamber is the same one who had issued the order of withdrawal of February 21, 2025. This order, which withdrew a previous decision (order no. 24 of November 21, 2024), was based on a reason deemed "light": the Santander bank had indicated that the suspension concerned disbursements and not financing.
The RV party believes that this new action by the Court has no real effect on the project, which remains stalled because Santander bank has maintained the suspension of disbursements. It is therefore clear that the only possible effect of this action would be to "give the impression that the proceedings before the Financial Judicial Pool have become pointless."
The party questions the intentions behind this maneuver: "Should we understand from this that the advisors of the administrative chambers would be more inclined to judge in accordance with the first order [...] and that the famous civil and commercial chamber which had decided on the retraction would be more favorable to the new doctrine?"
Faced with what it considers "unacceptable," the party is appealing to the President of the Republic, the High Council of the Judiciary, and the Union of Magistrates of Senegal (UMS). The RV demands that the risk that the planned intervention of the Supreme Court "will impact ongoing investigations at the Research Section" be taken seriously.
The RV party concluded by announcing that it will hold a press conference this Tuesday, December 16th at 3:30 PM at the Abass Sall Residence to elaborate on this subject, among other things.

NB c'est la cour suprême que SONKO disait qu'il faut balayer, c' est cette même cour suprême qui ne peut etre le protecteur de SONKO et cie , Attendons de voir le verdict moogueune parce que tôt ou tard la cour suprême doit s'empare et trancher cette affaire !!!
DANS CE SCANDAL FIGURE BEAUCOUP DE PERSONNE DE PASTEF ET DE LADMINISTRATION SENRGALAISE COMPLICE..... TAS TIENS BON....LA VERITE FINIRA PAR JAILLIR.
