Projet de loi sur l’accès à l’information : La société civile exige un texte plus inclusif et rigoureux
Citizen organizations, civil society actors, and press associations are calling for adjustments to the draft law on access to information, adopted by the Council of Ministers on July 30, 2025, to make it a tool truly dedicated to transparency and democracy in Senegal. In a press release published on Monday, August 25, 2025, these organizations welcome "the authorities' desire to strengthen transparency" through a legal framework that has been awaited for nearly twenty years. However, they believe that "the current text must be refined to meet international standards." They advocate for the inclusion, in the preamble, of the principle of maximum disclosure and the primacy of the right of access to information, in order to anchor this right as a fundamental pillar of Senegalese democracy. They also recommend clearly defining key concepts such as "subject," "information," and "qualification of the applicant" to avoid any ambiguity in the application of the law.
Limit exceptions to ensure transparency
Civil society emphasizes the need to strictly regulate exceptions to the right of access to information, specifying their content and scope. "Clarification is essential to prevent certain administrations from abusively invoking restrictions to the detriment of citizens," the press release states. To make access more inclusive, the organizations propose strengthening the proactive dissemination of public data, particularly via digital platforms, taking into account the needs of vulnerable groups, and establishing clear hierarchical appeal mechanisms in the event of refusal of access to information.
An independent commission for effective application
The stakeholders also call for the creation of an independent access to information commission, open to civil society and with financial autonomy. According to the signatories, this mechanism would guarantee the "impartiality and effectiveness" of the institution responsible for ensuring the application of the law. The signatory organizations, including CAP, CORED, SYNPICS, CJRS and Article 19, emphasize that these adjustments are crucial to make this bill an "effective instrument for transparency and citizen participation." The National Assembly is convened in plenary session this Tuesday, August 26, 2025 to examine this bill, seen as a major step forward for governance and democracy in Senegal.

Je suis vraiment surpris de constater que la presse sénégalaise qui aurait dû se féliciter et s'approprier cette loi n'en parle presque pas. Dans tous les pays développés ou qui juste se respectent, une loi d'accès à l'information est capitale. Cela ouvre beaucoup de perspectives au journaliste dans sa quête à une information juste tirée à la bonne source. Mais comme nous avons une presse pantouflard qui travaille juste pour désinformer et manipuler l'opinion alors cette loi ne l'intéresse pas.
