Affaire Ellipse Projects : Madiambal Diagne met en garde Emmanuel Macron
In an interview published this Thursday in Le Quotidien, one of Madiambal Diagne's lawyers, François Brengarth, announced that their client, who is the subject of an arrest warrant issued by the Senegalese justice system, has filed an appeal against the opinion of the Versailles investigating chamber, which partially ruled in favor of his extradition. "We expect the Court of Cassation, the highest court in the French judicial system, to overturn and annul the ruling that has been handed down," the lawyer declared.
If the decision is not overturned, the case would fall under the jurisdiction of the executive branch. In other words, a decree from French President Emmanuel Macron could lead to the extradition of Madiambal Diagne.
Faced with such a possibility, the defense team for the founder of the Avenir Communication group [publisher of the newspaper Le Quotidien] is adopting a two-pronged strategy. First, explains Mr. Brengarth, the aim will be to raise awareness within the French executive branch, "while respecting the principle of due process, regarding the numerous reasons that should prevent a decree from being issued. It is important to understand that we are not opposing the political nature of the measure in order to demand a political decision ourselves."
Madiambal Diagne's lawyer insisted: "We demand a decision that respects the law in force, nothing more and nothing less, and we demand that a decision be made independently of the exercise of diplomatic threats by the Senegalese authorities."
And if Macron orders the extradition of the journalist, the French lawyer announces that his decree to that effect will be challenged "before the Council of State, as part of an appeal for abuse of power".
