Plaidoyer pour un droit africain : « Il est impossible de réfléchir de manière endogène dans la langue de l’autre » (juriste)
Rethinking the approach to law in Africa through the promotion of the use of local languages in legal texts and judicial procedures: this is the plea of Senegalese jurist Fatou Kiné Camara.
For the doctor of private law and tenured lecturer at the Faculty of Legal and Political Sciences of Cheikh Anta Diop University in Dakar, it is necessary to develop "an African law rooted in the values and traditions of the continent, in particular by valuing local languages".
“I am a lawyer and I realize that we had a law that has nothing to do with the one that has been imposed on us since colonization. In Africa, we had a humanist law, which was based on fairness, which brought us peace and harmony,” she said in an interview with the Senegalese Press Agency.
The president of the Cultural Association for African Renaissance (ACRA) believes that "it is not possible to think endogenously in the language of the other."
"For a long time, they wanted us to believe that we were savages. However, language is of paramount importance, because it carries within it all our institutions and values," emphasizes the former president of the Association of Senegalese Jurists (AJS).
According to the legal expert, the law that was once in force on the continent (before the arrival of the colonizer) "has nothing to do with the one that was imposed." Based on research by several experts on African tradition, she hopes to contribute to the establishment of "a truly African law, founded on African values."
"As long as we do not master our own language, we cannot know who we are. And if we do not know who we are, we will never be able to reach the end of knowledge," she insists.
