Thiès : La surprenante décision d'une victime de vol émeut le tribunal
K. Ndiaye appeared before the Thiès court for the theft of Mr. Guèye's mobile phone. In court, the plaintiff explained that the defendant had broken into his home around 7 a.m. and taken his smartphone from his bedroom.
After discovering his phone was missing, Mr. Guèye followed the thief's trail, but the thief had already fled. When he called the number, the phone rang for a while before finally switching off.
Continuing his investigation, Mr. Guèye managed to identify K. Ndiaye. According to the evidence gathered, the accused had already sold the phone for 11,000 CFA francs. The police arrested him and remanded him in custody.
Before the judge, K. Ndiaye readily admitted to the charges against him. He explained that he had acted under the influence of alcohol. He also apologized to the victim, promising to abstain from both alcohol and marijuana.
Moved by the young man's family situation, the plaintiff surprised those present by announcing that he was granting him forgiveness. "I forgive him. I am not claiming any damages or interest because he is an orphan," Mr. Guèye declared in court.
Moved by this gesture, the defendant warmly thanked Mr. Guèye. "Thank you for forgiving me. May God reward you for your act," he prayed.
But the public prosecutor considered that the facts were established and requested the application of the law.
After deliberation, the court found K. Ndiaye guilty of theft and sentenced him to one month in prison and a fine of 50,000 CFA francs.
