Brésil: L'ex-président Bolsonaro se rapproche de la prison
Brazil's Supreme Court on Friday formally rejected former President Jair Bolsonaro's appeal against his 27-year prison sentence for attempted coup, significantly reducing his chances of avoiding jail time.
The court had already ruled against this appeal last week, but still had to ratify its decision.
The former far-right leader (2019-2022), 70, was found guilty in September of being the head of a "criminal organization" that conspired to ensure his "authoritarian hold on power" after the victory of his left-wing rival, Luiz Inacio Lula da Silva, in the October 2022 election.
According to the prosecution, this plot involved the assassination of Lula and a Supreme Court judge assigned to the case, Alexandre de Moraes. But it failed due to a lack of support from high-ranking military officials.
A court source told AFP that the defense could file a final appeal within five days. However, this could be quickly rejected by Mr. Moraes, which would end the proceedings.
Mr. Bolsonaro, who has been under house arrest since August, could therefore be imprisoned during the last week of November.
Due to health problems related to the after-effects of a stab wound to the abdomen in 2018, he could ask the Court to let him serve his sentence at home, as was the case for former president Fernando Collor de Mello (1990-1992), who was sentenced to eight years in prison for corruption.
- Sentence reduction excluded -
In its appeal, the defense of the former head of state had invoked "profound injustices", as well as "ambiguities, omissions, contradictions" of the trial, to demand a reduction of sentence, calling into question more the form than the substance of the case.
Judge Moraes rejected this request, believing that the trial had highlighted Jair Bolsonaro's leading role in an attempted coup.
He also reaffirmed his role as instigator of the events of January 8, 2023, when hundreds of his supporters stormed government buildings in Brasília.
Denying any "violation of the right to a defense," the judge asserted that all evidence had been made available to the lawyers. "The decision justifies all stages of the sentencing calculation," he wrote.
This trial has considerably worsened bilateral relations, particularly trade relations, with the United States under President Donald Trump, of which Jair Bolsonaro is a former ally.
Mr. Trump and his government are putting pressure on Brazilian judicial authorities, whom they accuse of unfairly prosecuting the former leader.
Mr. Moraes is Washington’s main target, having been subject to economic sanctions since the end of July, which were extended in September to his wife.
