AEE Power / ASER : Le grand déballage ! Les avocats de Seydou Kane révèlent le mystère des 37 milliards
It is a veritable media and legal counter-offensive that the collective of lawyers of Seydou Kane carried out this Tuesday, May 5, 2026. Faced with what they describe as "media blitz" and "smear campaign", the president of the Bar Association, Me Leity Ndiaye, accompanied by Mes Dior Diagne, El Hadji Amadou Sall, Boubacar Koïta and Abdou Dialy Kane, undertook to "deconstruct" the accusations weighing on the Senegalese businessman in the case opposing him to ASER.
ASER at the heart of the system: "She can't say she has clean hands"
One of the key points of this press conference was to remind the Senegalese Rural Electrification Agency (ASER) of its responsibilities. For Ms. Dior Diagne, the agency is far from being a passive player. "ASER is the driving force behind this entire process. Everything is done under its authority. It cannot claim to have clean hands," she emphasized.
The defense also disputes the claim that the contract was terminated by the State, noting that AEE Power Senegal was not in direct contact with the State: "There is no termination of the AEE Power contract by the State of Senegal. It is legally impossible."
The "stem of the matter": The mystery of the 37 billion start-up advance
The group has been particularly aggressive on the financial issue. According to their revelations, a start-up advance of 56 million euros (approximately 37 billion CFA francs) was disbursed in March 2024 under a sovereign guarantee from the State.
For the lawyers, it was this payment that triggered the abrupt expulsion of the Senegalese partner by the foreign company AEE Power OPCI. Attorney Leity Ndiaye thus posed the central question of the case: "Where did the initial advance payment in the AEE Power case go?" Attorney Boubacar Koïta added, denouncing a diversionary tactic: "They're talking about forgeries involving 900 million, but they remain silent on much larger sums... The only question that matters today is simple: where did the 37 billion of Senegalese taxpayers' money go?"
A strategic "joint venture," not simply subcontracting.
The defense sought to clarify the nature of the partnership. Contrary to popular belief, AEE Power Senegal was to carry out 60% of the work, significantly exceeding the legal subcontracting threshold (40%). "We are no longer dealing with subcontracting, but rather with joint contracting," the defense explained, emphasizing that Seydou Kane was the driving force behind the technical and financial structuring of the project, before being removed once the funds were secured.
4. Accusations of forgery deemed "inconsistent"
Regarding the accusations of forgery and use of forged documents, Seydou Kane's lawyers denounce a delaying tactic. They point out that the contract benefited from a total tax exemption. Therefore, "how can registration fees be demanded for a tax-exempt project?" asked Mr. Dior Diagne. According to the lawyers, these charges are merely an "unacknowledged but perceptible scheme" aimed at justifying the exclusion of the Senegalese operator in order to "capture the benefits of the financing."
5. A call for justice and the protection of local investors
Finally, Mr. Abdou Dialy Kane deplored the treatment of Senegalese businessmen. "This is what Seydou Kane, as a Senegalese citizen, did for his country, which is unfortunately trying to throw him to the wolves without any legal basis," he lamented. For Mr. El Hadji Amadou Sall, the severity of the accusations is unprecedented: "The accusations are brutal, sometimes even violent... We were attacked in front of the public, and it is therefore before them that we come to set the record straight."
The defense concludes by stating that "Seydou Kane is a victim, not a perpetrator," and calls on the judicial authorities to shed full light on the traceability of the public funds involved.
