On March 3, 2026, the Madrid-based company, represented by José Ángel González Tausz, filed a motion to set aside Judgment No. 04, issued on January 21, 2026, by the Second Civil and Commercial Chamber of the Supreme Court. Registered under number 099 in the general register, this action seeks to overturn a decision that has become highly controversial.
At the heart of this legal offensive lies a challenge to a ruling in an administrative matter. AEE Power intends to reopen the debate by relying on new evidence it considers crucial. This strategy demonstrates its desire to challenge the highest court's assessment of the facts.
This latest development is part of an already complex dispute between the company and the Senegalese Rural Electrification Agency (ASER). The case has been marked by several decisions from the ARCOP's Dispute Settlement Committee (CRD), some of which led to the precautionary suspension of the contract in question. Unsuccessful attempts at conciliation and tense exchanges of correspondence have left the atmosphere between the parties highly charged.
