Affaire Dr Cheikh Kanté : Son avocat fustige des « accusations tronquées » et annonce une riposte judiciaire
The case of the alleged illegal occupation of land by Dr. Cheikh Kanté has taken an offensive turn. Following his client's hearing, lawyer El Hadji Badara Ndiaye has spoken out to denounce a procedure he considers unfounded and motivated by malicious intent.
The defense argues that the complaint filed by Mr. El Hadji Djigal, acting on behalf of the family of the late Mamadou Diagne, lacks legal substance. The lawyer emphasizes that the accusations of forgery and illegal occupation are based on no tangible evidence.
“Nothing has been substantiated in this complaint, nothing has been justified or systematic,” insists Mr. Ndiaye. According to him, the plaintiff has merely resorted to “putativity to tarnish the image” of his client based on “a collection of truncated and puerile accusations.”
When questioned by investigators, Dr. Cheikh Kanté presented what he considers an unassailable case to justify his ownership of the disputed Land Title. The defense notably produced the notarized deed of transfer dating from 1995, the NICAD (National Register of Cadastre and Cadastre), as well as a recent statement of real rights indicating "no encumbrances or easements."
For Mr. Ndiaye, the chronology of events leaves no room for doubt: "It is clear that the legal and factual basis for the accusations levelled against Mr. Cheikh Kanté is fundamentally speculative." He adds that this accusation now lies "outside the bounds of legal reason."
The former minister's lawyer sees this case as a behind-the-scenes maneuver. He refers to "irrational contradictions" in which the plaintiff has allegedly become entangled, suggesting a desire to distort reality for "unacknowledged political reasons."
Determined not to let his client's image be tarnished, lawyer El Hadji Badara Ndiaye announced an immediate counter-attack in court. "I will file a complaint on Monday with the Public Prosecutor of the High Court of Dakar against all those involved in this outrageous crime, so that the law may prevail," he concluded.
