Affaire "Sos Keur Yeurmandé" : À l'approche du verdict, la défense de Ndella Madior Diouf hausse le ton
The Dakar criminal court is expected to deliver its verdict soon in the so-called "SOS Keur Yeurmandè" case, in which Ndella Madior Diouf is the main defendant. As the verdict approaches, the defense team for the former children's home director and youth center manager has spoken out to denounce the conditions of their client's detention.
At the hearing on May 28, 2026, the criminal court granted provisional release to Ndella Madior Diouf and her co-defendants. However, this decision was ultimately not implemented following an appeal by the public prosecutor's office. This situation is strongly denounced by Ousseynou Gaye, one of Ndella Madior Diouf's lawyers.
“During the hearing before the criminal court, Ndella Madior’s lawyers pleaded and obtained her provisional release. The criminal court granted the request, noting that the prosecutor had requested the acquittal of the accused on several charges, to such an extent that the case had lost all criminal connotation,” the lawyer stated.
According to Ms. Gaye, the court also determined that her client presented "serious guarantees of appearing in court." Despite this, the prosecution appealed the decision. For Ms. Gaye, this appeal cannot justify her client's continued detention. "Besides the fact that the appeal is inappropriate, there is the very curious fact that Ndella is being held illegally and arbitrarily," the lawyer argued.
The lawyer elaborated, citing a provision of the Code of Criminal Procedure. "Indeed, only appeals against provisional release orders issued by the investigating judge have suspensive effect. In this case, it is an appeal against a judgment of the criminal chamber. However, no provision of the Code of Criminal Procedure, particularly articles 319 et seq., stipulates that in the event of an appeal by the public prosecutor against a judgment of the criminal chamber, the detainee is kept in prison," he explained.
The defense argues that Ndella Madior Diouf's current detention constitutes "a serious violation of the law." Attorney Gaye added: "Consequently, Ndella Madior's detention constitutes a serious violation of the law, amounting to a particularly inhumane form of confinement, especially given that our client is facing a medical emergency," insisted Attorney Ousseynou Gaye.
Despite this procedural battle, the defense remains optimistic about the outcome of the deliberations. "We are hopeful that she will soon regain her freedom," the lawyer concluded.
