Assault on a customer: A Yango driver faces 2 years in prison

Mbaye Fall, a 34-year-old driver, faces a two-year prison sentence for robbery with assault, battery, and property damage. He was tried this Monday before the Pikine-Guédiawaye court for flagrant offenses.

During a ride booked through the Yango app, the driver assaulted his passenger, Sokhna Tine Diop. The woman filed a complaint at the Golf Sud police station.

In her statement, the victim, a resident of Ngor Almadies, explained that she had ordered a taxi to go to the Golf Sud police station. However, she said the driver changed her destination without her consent, taking her to another location. After calling her back to her original destination, the driver tried to grab her phone and beat her, causing visible facial injuries. She was taken to Dalal Jamm Hospital, where she was issued a medical certificate with a seven-day period of temporary incapacity for work (ITT).

When questioned, Mbaye Fall, a Yango driver for two months, admitted to snatching the complainant's glasses but denied any physical assault. According to his version of events, the plaintiff got the wrong address and insisted on handing over her phone, which he refused. The defendant added that the victim bit his finger.

The incident was observed by a traffic officer, who stopped the driver and accompanied him and the victim to the Golf Sud police station.

Before the judge, the defendant denied the theft charges, but admitted to snatching the glasses from the plaintiff.

The ride-hailing company Yango was held civilly liable. Represented by the law firm Houda et Associés, Yango asked the court to dismiss the case, arguing that there was no employer-employee relationship.

Assisted by lawyer Abdou Aziz Diop, the plaintiff Sokhna Tine Diop claimed the sum of 50 million FCFA in damages.

In his closing argument, the public prosecutor stated that the facts were undisputed. He requested a two-year prison sentence for the defendant.

The defense, represented by Abdou Aziz Djigo, argued primarily for the dismissal of the charges. As a secondary argument, the lawyer requested that the charges be reduced to assault and battery, before ultimately asking for leniency.

The case is adjourned for deliberation until April 3, 2026.

    Yango doit etre condamnee a payer les dommages et interets. C'est elle qui a un contrat avec le chauffeur et devrait s'assurer de son professionalisme et de sa moralite a travers la formation, son certificat de bonne vie et moeurs et son casier judiciaire. Yango gagne doublement a chaque course, sur le client et sur le chauffeur contrairement aux USA ou Uber ne soutire pas aux chauffeurs
