Bras de fer à West African Energy : nouveau revers pour Moustapha Ndiaye face à Samuel Sarr
The power struggle between West African Energy (WAE) shareholders continues unabated. On March 17, the Dakar Commercial Court ruled in favor of Afrinvest, represented by Samuel Sarr, by annulling the minutes of the Board of Directors meeting of January 20, 2025.
This meeting, convened by Moustapha Ndiaye, concerned two strategic decisions for the company's management: the transfer of the head office and the authorization to sign a cash advance agreement. In the same ruling, the court ordered Moustapha Ndiaye, as well as the companies Groupe Citaf International, Locafrique Holding SA, and Senelec SA, to pay court costs, according to Libération, which broke the story.
This verdict marks a major turning point for Samuel Sarr. The WAE shareholder and CEO has always contested Moustapha Ndiaye's status as Chairman of the Board, which led to the criminal proceedings that resulted in Sarr's detention at the end of November 2024. While he has since been granted provisional release, this was conditional upon house arrest and the wearing of an electronic bracelet as part of the investigation.
This decision comes on top of a previous legal victory: the Court of Appeal's annulment of Samuel Sarr's referral to the criminal court due to a procedural flaw. The lawyers for the former Minister of Energy under Abdoulaye Wade now intend to fully exploit this ruling, which, according to the daily newspaper, undermines the legitimacy of the opposing party's actions.
