Interpellation de Madiambal en France : Un juriste décortique la procédure d’extradition
Following the international arrest warrant issued by the Senegalese government, Madiambal Diagne was arrested in France this Tuesday. Will he be automatically extradited to Senegal by the French courts? Mamadou Yaya Diallo, a research professor specializing in international law, analyzed the procedure in an interview published on Seneweb on October 2.
"The French judicial authorities will assess the request made by the Senegalese investigating judge. The execution of the international arrest warrant can only be decided by the French authorities after verifying a certain number of things," he stressed in the interview.
According to the lawyer, the French justice system will verify whether Madiambal is being prosecuted for a common law offense provided for and punishable by the laws of both countries and not for his political opinions. Then, they will verify his nationality, since "if he has both Senegalese and French nationality, he is not likely to be transferred," Mr. Diallo said.
And if France decides to grant Senegal's request and decides to extradite Madiambal Diagne, the latter, "like any person subject to trial, found on French territory, has the right to challenge the order providing for his transfer before the investigating chamber (the equivalent, in Senegal, of the indictment chamber)," the Jurist specified.
The decision rendered by this chamber can, however, be subject to an appeal in cassation before the highest court of the judicial system, in this case, the Court of Cassation. "The execution of all these legal remedies considerably delays the implementation of the international arrest warrant," the lawyer indicated.
Mr. Diallo also emphasized that Article 59 of the Judicial Cooperation Convention signed in 1974 provides that countries undertake to reciprocally extradite persons prosecuted or convicted by the judicial authorities of the other country. Therefore, the sovereignty of the French state is limited by the obligation to comply with international law.
"But international extradition practice shows that the requested State, in this case France, can refuse to grant a favourable response when it considers that the facts for which Mr DIAGNE is being prosecuted are of a political nature," he points out.

Son journal se vend à 100 frqncs le numéro. Il peut etre poursuivi pour association de malfaiteurs, blanchiment d'argent, d'escroquerie ! Madiambal doit savoir que notre pays a élu des mains propres dont les statures dépassent celle de son père !
