Justice et numérique : Le procureur général Jean-Louis Toupane alerte sur les risques d’exclusion
On the occasion of the formal opening of the Courts and Tribunals, the Attorney General at the Supreme Court, Jean-Louis Toupane, warned against the challenges posed by the increasing digitization of judicial institutions.
According to him, "the opportunities offered by digital technology in terms of efficiency and modernization can be real." But, the senior magistrate warns, "increased vigilance is needed regarding the risks of exclusion and imbalance that a poorly managed transition could generate."
In his address, Jean-Louis Toupane emphasized that digital technology has become an essential lever for transforming public action, including in the judicial field. "The dematerialization of procedures, electronic case management, and digital access to legal information are all innovations that can help bring justice closer to the citizen and improve its functioning."
However, the Attorney General was careful to point out that this development should not be considered a neutral or universal solution. "Modernization must not create new forms of injustice," he insisted, highlighting the risk of marginalizing the most vulnerable populations, those unfamiliar with digital tools or lacking stable access to technology.
According to him, an excessively digitized justice system, without sufficient human support, could exacerbate inequalities in access to justice and weaken the fundamental principle of equality before the law. He warned that digital technology must neither distance litigants from the judge nor reduce the judicial process to a mere technical procedure.
Jean-Louis Toupane also emphasized the ethical dimension of this transition. According to him, the protection of personal data, the transparency of algorithms, the reliability of digital tools, and respect for individual freedoms are major issues that directly concern judges and public decision-makers.
He reminded everyone that justice cannot afford to sacrifice its fundamental principles on the altar of technological performance.
Beyond the digital realm, the Attorney General placed his remarks within a broader reflection on the future of justice and the rule of law. He emphasized the central role of the judge as guarantor of freedoms and social cohesion, in a context marked by profound social, economic, and technological changes.
Finally, Jean-Louis Toupane called for a balanced and progressive approach to the digital transformation of justice, based on the training of judicial actors, the support of citizens and the maintenance of a strong human link between the judge and the litigant.
A successful modernization, he concluded, "is one that strengthens citizens' trust in the judicial institution, without leaving anyone behind."
