Liberté provisoire refusée : l’argument du procureur pour maintenir Farba Ngom en prison
The financial prosecutor's office has filed an appeal with the Supreme Court against the indictment chamber's decision to grant Farba Ngom provisional release, subject to judicial supervision, thereby overturning the investigating judge's verdict. According to Les Échos, which reported the news in its Thursday edition, the prosecutor invoked a single argument to support his appeal: a violation of Article 140 of the Code of Criminal Procedure. "In short," the newspaper explains, "granting Farba Ngom provisional release violates this provision."
The same source recalls that "Article 140 of the Code of Criminal Procedure stipulates, in substance, that for persons prosecuted for embezzlement, misappropriation or fraudulent obtaining of public funds, when the amount is equal to or greater than one million francs, a warrant for committal is mandatory. It goes on to say that the warrant for committal can only be lifted if the missing amount is fully reimbursed or bailed, is subject to serious dispute, or if, exceptionally, a medical expert report establishes that the accused's state of health is incompatible with detention in a prison environment."
If the prosecution considers that these conditions are not met by their client, the lawyers for the mayor of Agnams, who must produce their reply, argue the opposite, according to Les Échos.
