The digital transformation of the judicial system is now one of the major challenges of state modernization. In Senegal, this evolution raises both hopes and questions, particularly regarding the role of the judge in an increasingly digital environment. During his address at the formal opening ceremony of the courts, the President of the Bar Association emphasized that "digital technology will never replace the judge's conscience." The rise of information technologies has profoundly altered the nature of the disputes brought before the courts. Offenses related to cyberspace, litigation based on digital evidence, and violations of privacy or personal data require new expertise from judges, without, however, altering the fundamental principles of the judicial process.

“Emails, social media posts, electronic recordings, and computer data are now central to many trials. Their use requires rigor and caution. The judge remains obligated to verify their authenticity, legality, and probative value, in strict compliance with the rights of the defense and the principle of adversarial proceedings,” argues the lawyer. For the President of the Bar Association, this evolution necessitates continuous adaptation of the law and enhanced training for judges and legal professionals, so that technology strengthens justice rather than weakens it. “The digitization of procedures offers positive prospects: faster processing of cases, improved access to justice, and greater transparency in decisions.”

However, it cannot lead to automated justice. Judgment remains a human act, based on the analysis of the facts, listening to the parties and the enlightened application of the law,” he said.

Artificial intelligence under human control

Furthermore, the lawyer explains that "while artificial intelligence can support judicial work, particularly in legal research or case management, it cannot replace the judge's responsibility." As the President of the Bar Association reminds us, judicial decisions involve fundamental values: freedom, dignity, and fairness, "which cannot be delegated to an algorithm." "Faced with these challenges, strengthening the legal framework, investing in digital infrastructure, and providing continuing professional development are priorities. The digital transition of the justice system must be carried out with respect for judicial independence and fundamental rights," he concludes.
