Procès Saer Diagne : L'affaire choquante du vigile de confiance du colonel accusé du pire sur sa fille de 14 ans
Five years in prison! That's the sentence requested by the public prosecutor against Mr. Diagne, known as Saer, a 39-year-old security guard. He is accused of rape, pedophilia, abduction of a minor, and corruption of a minor involving the daughter of a colonel, who was 14 years old at the time of the events. The case was heard this Tuesday in the criminal court of Dakar. The events took place in Mermoz during 2022.
During the adversarial proceedings, the victim, K. Dieng, assisted by her mother, recounted this dark period of her life. “I was 14 years old at the time. Saer was a security guard in our neighborhood. One day, I was coming home from school. My mother had asked me to go get some bottles at the Tilène market, because she sells juice. On the way, I ran into him. He offered to give me a ride in his car. When we got to the teacher training college, he told me I could buy the bottles at Parc Lambaye, in Grand Dakar,” the plaintiff stated before continuing.
“He told me he was going to his sister’s place first. He parked on the corner, leaving me alone in the car. A few moments later, his sister came and asked me to get in, claiming that Grand Dakar wasn’t safe,” the young woman recounted. She continued, “When I arrived, I saw an unfinished but inhabited building. I found a woman holding a child. She showed me to a room. Saer went out onto the terrace. The woman asked me about my education level, then if I had a boyfriend. I told her no. She confided that she had run away to live with her boyfriend. I told her that was none of my business. She called me undisciplined. As we spoke, she kept saying I didn’t know what was happening to me. Saer came back with a bottle of beer and a joint of marijuana. The woman closed the door behind her,” she said.
Continuing her account of her ordeal, K. Dieng described the first rape. “He asked me to drink alcohol and smoke a joint. I refused. That's when he threatened me in a firm tone. Out of fear, I complied. Then he undressed. He asked me to do the same. Since I was slow, he took off my clothes himself. Then he started kissing and groping me. I screamed, but no one came to my aid. He put on a condom. He penetrated me, slapping me repeatedly before strangling me. I choked at one point. After he did it, he told me, ‘There's no point in crying. That's what your mother and father do,’” the plaintiff said, shocking the public in courtroom 4 of the Lat Dior courthouse. "Afterwards, he took a taxi for me. When I got home, I noticed there was blood on my underwear. I went to wash myself," she said.
For the second time, K. Dieng explained that Saer had abused her in the community hall. “On my mother’s instructions, I was bringing him a dish for dinner. His colleague, Guèye, asked me to go get him because he was behind the building washing himself. When I went to get him, he took me by surprise from behind. He had already put on a condom. He put his hand over my mouth to stop me from screaming. He sodomized me. When I returned to the guard post, his colleague had already left. When I got home, my mother even slapped me, telling me I had stayed there too long,” the girl recounted.
Regarding the third incident, she recounts: “It was around 10 a.m. I was coming home from school. He saw me go up to the apartment. He came to tell me that my father had asked him to check if I was home alone. Since my father was in the habit of doing that, I believed him. He found me in the living room with my tablet. But then I went to my room where he joined me. He tried again to have sex with me. I threatened him with a knife that was on the bed. He said to me, ‘Now you threaten me with a knife.’ He left,” the complainant states.
The judge questioned her about the nature of their relationship. She stated, “He was a security guard in our housing project. My father had taken him in because he used to buy candy for my younger brothers and drive them to the hairdresser.” K. Dieng added, “I couldn’t tell my parents about my ordeal because I was afraid. I was often the cause of their problems. In fact, one day, I was going to Saer’s house in Cambérène because they had had a fight. That morning, I contacted Saer and told him I wanted to go out. He advised me to run away.”
When questioned, her mother stated that Saer had been introduced to them by her husband, the colonel. He had asked them to provide food for her every day. At first, she disagreed, but eventually agreed. “My daughter complained of stomach pains. I told her it might be her period. I noticed her grades had dropped. I insisted, threatening to take her to the gynecologist. She cried. That's when she told me she had gone to the beach on a school trip and that someone had raped her. The next day, I called her friend Emilie. When I got home, I questioned my daughter again, and she told me it was Saer who had raped her,” she said. The mother concluded, “We considered Saer a member of the family. My husband died in February because this affair affected him so deeply.”
The accused denies it
When questioned, Massaré Diagne, who was remanded in custody on April 8, 2022, denied everything. "That's not true. I was assigned to the housing project in 2021. I only went there three times." The presiding judge reminded him that he had stated before the investigating magistrate that he had gone to the victim's home for some work. "I never said that," he refuted.
Regarding the bottle incident, he explains: "It was 1 p.m., I was going to Grand Dakar. She told me that her mother was sending her to buy some bottles. I drove her to Lambaye Park. She bought the bottles, then we went home."
Regarding the visit to Cambérène, he recounts: “She called me to tell me she wanted to run away because her mother had threatened her after seeing her with a boy named Lito. She insisted on coming to my house by taxi. When she arrived, I advised her to go home. Afterwards, I drove her to a friend of her mother's and called her mother to come and pick her up.”
Prosecutor's indictment
The prosecutor emphasized that the victim's statements had never wavered. The medical certificate dated March 31, 2022, revealed old hymenal tears, confirming penetration. The prosecution argued that a 14-year-old girl could not have fabricated such a plan against a security guard whom her own family was assisting. The prosecutor requested a 15-year prison sentence.
The defense, led by Ibrahima Mbengue, argued for acquittal, stating that there was no tangible evidence and that indirect testimony did not constitute proof in law.
The case has been adjourned for deliberation until June 2nd.
