The verdict was reached two months ago in the dispute between Africa Distribution and Services (ADIS) and the Directorate General of Taxes and State Property (DGID) and the State Legal Agent (AJE). In its ruling issued on Tuesday, February 3rd, the Second Civil Chamber of the Dakar Court declared that the withdrawal of the lease at issue from ADIS, due to public utility reasons, entitles the holder to compensation, which it set at 5 billion CFA francs.
Les Échos, which broke the story, reports that the State has been ordered to pay the aforementioned amount, noting that the court dismissed the case against AJE and assigned the costs to the public treasury. A small consolation for the State: the judge rejected ADIS's claim for damages, citing "abusive resistance," and did not order the provisional enforcement of the judgment.
