The Thiès court heard a case of attempted robbery on Monday, May 4th, involving a 25-year-old man. C. Samb is being prosecuted for breaking into Mr. Djiba's home in the middle of the night.
According to the complainant, the incident occurred around 3:00 a.m., while the entire family was asleep. He claims to have sensed the presence of an individual attempting to open his bedroom door. When the door resisted, the intruder went to the kitchen before returning.
It was at this moment that Mr. Djiba says he surprised and subdued him, before alerting the neighbors. The suspect was then taken to the police station and subsequently remanded in custody.
In court, C. Samb attempted to deny any intention of stealing. He explained that he was returning from a "thiant" (religious gathering) and that he had entered the house in search of a friend named Cheikh.
This version of events was strongly contested by the plaintiff, who asserted that no one by that name lived on the property. The plaintiff also stated that the defendant had climbed the wall to gain entry. When questioned at the scene, C. Samb claimed he was simply looking for a place to spend the night.
Having established the facts, the public prosecutor requested the application of the law. The court found C. Samb guilty of attempted theft. He was sentenced to two years' imprisonment, with two months to be served. He will also have to pay 50,000 FCFA in damages to the plaintiff.
