Tribunal de Mbour : Un prévenu condamné à un an de prison ferme, pour avoir agressé un professeur avec une bouteille

The Mbour court of first instance, sitting in correctional session, sentenced Philippe Maurice Sonko Badgi to one year in prison, following a violent altercation at the Saly intersection against Professor M. Fall.

In court, the defendant explained that he had approached Mr. Fall to offer him a ride on a motorcycle taxi. According to him, Mr. Fall's reaction was aggressive. He claims he was attacked first, stating that Mr. Fall threw a bottle at him, which shattered on the ground, before grabbing him and knocking him to the ground. He maintains that he only shoved Mr. Fall, causing him to fall onto broken glass, which he says explains his injuries.

This version of events is vigorously contested by the plaintiff. Mr. Fall recounts that he was grabbed and falsely accused by the defendant at the Saly intersection. An argument ensued before witnesses intervened. As he attempted to hail a taxi, Philippe Maurice Sonko Badgi allegedly returned, smashed a wine bottle on the sidewalk, and struck him several times.

To support his claims, the plaintiff presented the court with a white Lacoste t-shirt, stained with blood, to demonstrate the violence of the attack and the significant blood loss he suffered. Mr. Fall also stated that he lost 150,000 CFA francs and a gold chain during the altercation. Since that tragic evening, he has been experiencing excruciating pain and vomiting blood. He is seeking five million CFA francs in damages.

In his closing arguments, the public prosecutor denounced the defendant's "manifest bad faith," arguing that he had attempted to reverse the roles. According to the prosecution, the victim narrowly escaped death and suffered serious consequences. The magistrate emphasized the defendant's dangerousness, calling for the protection of citizens against such violence. He requested a two-year prison sentence, with one year to be served.

The defense, for its part, argued that the defendant was intoxicated, maintaining that he was not fully aware of his actions at the time of the incident. The lawyer requested a more lenient sentence, emphasizing the need for counseling and alcohol rehabilitation, while also requesting a reduction in the amount of damages awarded.

At the end of the proceedings, the court declared Philippe Maurice Sonko Badgi guilty and sentenced him to one year in prison, along with the payment of 700,000 CFA francs in damages to the civil party.
