Prime Minister Ousmane Sonko announced the draft bill during the last session on current affairs at the National Assembly. The bill was then adopted by the deputies on Wednesday, March 11. Law No. 2026-08 of March 27, 2026, amending Article 319 of Law No. 65-60 of July 21, 1965, has now been promulgated by the President of the Republic. The text, which clarifies the concept of an unnatural act and increases penalties, is now in effect. Below are the details of the law as published in the Official Gazette on Monday, March 30, 2026.
"Sole Article. - The provisions of Article 319 of the Penal Code are amended as follows:"
Article 319. - The following constitute an act against nature: any sexual act or act of a sexual nature between two persons of the same sex; any sexual act or act of a sexual nature committed by a person of either sex on a human corpse or on an animal.
Anyone who commits an unnatural act will be punished with imprisonment of 5 to 10 years and a fine of 2,000,000 to 10,000,000 CFA francs, without prejudice to the penalties provided for in cases of rape or pedophilia.
If the unnatural act is committed with a minor, the maximum sentence will be imposed.
The judge may not grant a suspended sentence, nor reduce the imprisonment below the minimum penalty provided for in paragraph 2 of this article.
Any public representation, by word, writing, image, gesture, sound or by any other means whatsoever, tending to promote homosexuality, bisexuality, transsexuality, zoophilia, necrophilia or any other assimilated practice constitutes the apology of an unnatural act.
Any person who, by one of the means set out in Article 248 of this Code, has made an apology for an act referred to in the first paragraph of this article, shall be punished by imprisonment of 03 to 07 years and a fine of 500,000 to 5,000,000 CFA francs.
Any person who deliberately finances or supports, by any means whatsoever, a person, group or activity with a view to promoting or glorifying homosexuality, bisexuality, transsexuality, zoophilia, necrophilia or any other similar practice, shall be punished by the penalties provided for in paragraph 6 of this article.
Persons found guilty of the offences provided for in the preceding paragraphs of this article shall be deprived of the rights listed in article 34 of this Code, for a period of 10 years, from the day on which the principal sentences became final.
Any person who in bad faith denounces, by one of the means stated in Article 248 of this Code, one of the acts provided for in this article, shall be punished by imprisonment of 02 to 05 years and a fine of 500,000 to 2,000,000 CFA francs.
This law shall be executed as a law of the State. Done at Dakar, on March 27, 2026.
