Guédiawaye : un faux lieutenant des douanes pris dans des opérations de dédouanement fantômes

A retiree named Maleyni Aïdara was found guilty of impersonating a public official and breach of trust, and sentenced to six months' imprisonment, suspended. He must also pay 5.1 million CFA francs, 400,000, and 100,000, respectively, to Mathieu Ndig Faye, Ousmane Sarr, and Awa Thiam, the plaintiffs in the trial that took place on Friday before the Pikine/Guédiawaye Magistrates' Court.

The plaintiffs accuse Aïdara of being an accomplice of C. Seck, the man who allegedly promised them, in vain, to get their containers out of the Port of Dakar. According to L'Observateur, which attended the hearing, Seck is on the run, which meant the retiree was alone in the dock.

The victim of the greatest financial loss (5.1 million CFA francs) in this affair, Mathieu Ndig Faye, stated, according to the daily newspaper, that he made 34 transactions without his container ever leaving the port. The money, he said, was sent to Aïdara when Seck declared his account balance had reached its limit. Faye finally filed a complaint on April 29, 2024, after more than a year of missed appointments.

Awa Thiam, for her part, states that Aïdara presented himself to her as a customs lieutenant, capable of advancing her case, which had been entrusted to Seck. The complainant claims to have sent 100,000 CFA francs to the retiree, without receiving anything in return. Maleyni Aïdara refuted these accusations, swearing that he had "only seen [Awa Thiam] at the police station" and had never stated that he was a customs officer.

However, the retiree admitted to receiving the 460,000 that Ousmane Sarr, the third plaintiff, claims to have paid him. But he was quick to clarify that he collected the money on behalf of C. Seck.

Arguing for Aïdara, the defense attorney dismissed the fraud charge but acknowledged the breach of trust. He further emphasized that the accused had already been convicted on this charge and had, in fact, appeared in court after being brought from prison.

Unmoved by the lawyer's plea, the prosecutor requested a three-month prison sentence for the retiree on charges of breach of trust and identity theft. Drawing on his last reserves of strength, the defense attorney begged for leniency. The judge refused: Maleyni Aïdara received a six-month suspended sentence in addition to his existing term. This was in addition to the financial penalties imposed by the court.
