Insolite à Notto Gouye Diama : Une chèvre volée retrouvée dans la salle de bain d’un maçon
The High Court examined an unusual case from Notto Gouye Diama, in the department of Tivaouane. A mason, Mr. Thiam, is being prosecuted for stealing a goat belonging to his neighbor, R. Diallo.
In court, the defendant denied any criminal intent, offering a rather unusual explanation. According to him, the animal regularly entered his property to graze on his hay. He claimed to have captured the goat in order to find its owner. To justify the animal's presence in his bathroom, Mr. Thiam stated that he only kept it there for its safety while he went to work on his construction sites.
The plaintiff strongly contests this version of events. R. Diallo stated that her livestock had disappeared for 20 days before finally being located in the accused's pond. She also pointed out the close proximity of their homes, emphasizing that it would have been easy for the mason to report the goat's presence in the neighborhood. She is claiming 700,000 FCFA in damages for the harm suffered.
The public prosecutor, considering that the intent to steal was not clearly established but that the prolonged detention was suspicious, requested that the charges be reduced from theft to receiving stolen goods. He sought a three-month prison sentence for the bricklayer.
The court has taken the case under advisement and will render its decision soon.

Donc, comme disent mes cousins Peuls "JETKO FALA WONA NGUYKA". Quelqu'un qui garde la chèvre d'autrui dans sa salle de bain (donc à l'abri du regard de visiteurs éventuels) pendant 20 jours et on nous dit que l'intention de vol n'était pas établi? J'ai sincèrement l'impression que nos lois sont désormais en déphasage avec notre réalité sociale, voire même la morale sociale. D'où souvent ce sentiment d'injustice chez les victimes après chaque verdict.
