Litige foncier à Keur Moussa : QVS doit "libérer les lieux occupés illégalement" sous peine d’une astreinte de "500 000 FCfa par jour de retard"
The land dispute, which has been ongoing for several years, between the agricultural farm Qualité Végétale Sénégal (QVS) in Keur Moussa (department of Thiès), owned by Dutch capital, and the Société Nouvelles Villes (SNV) of local promoter Tidiane Diawara, has just taken a decisive turn.
The Appeals Chamber of the Thiès Court of Appeal issued a ruling on December 24, 2025, ordering QVS to "vacate the illegally occupied premises," under penalty of a fine of "500,000 FCFA per day of delay." It considers that, according to Article 29 of the Uniform Act on Simplified Debt Recovery Procedures and Enforcement Measures (AU/PSRVE) of November 15, 2023, "the State is obligated to assist in the enforcement of decisions and other enforceable instruments."
The judge held the State liable, requiring it to compensate for all damages resulting from the non-execution of the final court decision. Based on this decision, bailiff Cheikh Tidiane Tambédou served QVS with an eviction order on January 15, 2026, subject to a penalty of 500,000 francs per day of delay.
The Republic of Senegal, in accordance with the enforcement order, commands and orders all bailiffs, upon request, to execute this decision, and in particular the Attorneys General and the Public Prosecutors at the regional courts to ensure its enforcement. Furthermore, all commanders and officers of the public forces are ordered to provide assistance when legally required.
