Marché du siège de la DER/FJ : L’ARCOP suspend la procédure après le recours de SERTEM Groupe
The dispute between the General Delegation for Rapid Entrepreneurship for Women and Youth (DER/FJ) and SERTEM Group has taken a major turn. The construction company appears to be in the upper hand in this standoff.
According to Seneweb, the Public Procurement Regulatory Authority (ARCOP) issued a ruling in its favor on April 9, 2026. The body ordered the suspension of the tendering process for the contract related to the construction of the Mohamed Bin Zayed Entrepreneurship and Innovation Center, headquarters of the DER/FJ, valued at 17 billion CFA francs.
This decision follows the appeal filed by SERTEM Groupe, the initial awardee of the contract. Furthermore, in decision no. 030/2026/ARCOP/CRD/SUS issued on April 2, 2026, the Dispute Settlement Committee (CRD) declared admissible the legal appeal filed by SERTEM, which contests the provisional award of this contract initiated by DER/FJ.
Consequently, the regulatory body has decided to suspend the procurement process for this public contract, which was initiated through a restricted tender under an emergency procedure. This suspension is accompanied by an order requiring DER/FJ to provide all documents in the file deemed necessary for investigating the dispute.
This precautionary measure aims to guarantee respect for the principles of fairness, transparency and impartiality in public procurement, while the CRD examines the substance of the dispute between the parties.
The decision has been notified to the various parties concerned, including SERTEM Group, DER/FJ, and the Central Directorate of Public Procurement (DCMP). It must also be published on the official public procurement website, in accordance with applicable regulations.
