The Thiès Court of flagrant offenses judged on Friday, June 19, a case of abduction of a minor and indecent assault involving A. Sarr (28 years old), M. Tabane (23 years old) and M. Seck (24 years old), all residing in the Medina Fall district of Thiès.
According to the prosecution, the three defendants allegedly had sexual relations with Y. Diouf, a 16-year-old girl. During the proceedings, it was also indicated that the young girl presented a particular vulnerability.
In court, the three men denied the charges against them. They claimed they had never had sexual relations with the complainant.
When questioned by the court, Y. Diouf gave a different account. She stated that the defendant, A. Sarr, contacted her regularly by phone before inviting her to a house where they had sexual relations on several occasions. The young woman clarified that she had consented.
Regarding Mr. Tabane, whom she describes as her neighbor, she stated that he had been having sexual relations with her since she was 13 years old. According to her statements, he would sometimes pick her up on his motorcycle to take her to different places.
Regarding Mr. Seck, the complainant explained that they met by chance before he obtained her phone number. According to Y. Diouf, this man then began inviting her to intimate encounters. She claims to have had several sexual encounters with him.
The minor also named a fourth individual, identified as Fallou. According to her statements, he also had sexual relations with her and filmed some of their encounters. She emphasized that he is currently on the run.
For her part, the teenager's aunt stated that she had discovered a cell phone in her niece's possession. After confiscating the device, whose origin was dubious, she noticed that several men were regularly contacting the young girl to arrange dates. When questioned about these calls, the teenager revealed the existence of these relationships. The aunt then informed her husband, who filed a complaint with the police, leading to an investigation and the arrest of the suspects. "All three were caught in a trap when they called the girl to arrange a meeting," the aunt explained.
In his closing argument, the public prosecutor maintained that the defendants had transported the minor to various locations in order to have sexual relations with her. He argued that their denials before the court were unsupported by any evidence. The prosecutor asserted that the defendants had objectified the girl, who lacked full mental capacity. He therefore asked the judge to find them all guilty of abduction of a minor and indecent assault, and to sentence each of them to two years' imprisonment.
The case has been adjourned for deliberation.
