Offense aux prérogatives du Chef de l’État : Une infraction impossible sans délégation expresse, selon Thierno Bocoum
In a legal analysis published this Thursday, Thierno Bocoum, president of AGIR-LES LEADERS, denounces the abusive application of the offense of "offending a person having the prerogatives of the Head of State" in Senegal, in the absence of an express delegation of powers. Relying on Article 50 of the Constitution, which stipulates that the President may delegate certain powers by decree, and Article 254 paragraph 2 of the Penal Code, which punishes offending a person exercising these prerogatives, Bocoum emphasizes that any delegation must be explicit and cannot be tacit.
For him, without an official decree transferring these prerogatives, no prosecution can be validly initiated. "Without transferred prerogatives, there is no possible offense," he argues, invoking the principle of nullum crimen, nulla poena sine lege ("no crime, no punishment without law"). He thus welcomes the acquittal of Assane Diouf and Bah Diakhaté by the judges, in the face of the relentless pursuit of a public prosecutor who, according to him, is inventing a non-existent offense. Thierno Bocoum concludes that such practices constitute an "abuse of law," synonymous with arbitrariness, and calls for respect for the foundations of criminal law to preserve justice in Senegal.
This statement comes as journalist Doudou Coulibaly was imprisoned on Thursday on this charge.

Son discours, c'est de l'opportunisme pur et simple, une tentative de surfer sur la vague médiatique pour se faire passer pour un défenseur des libertés. En réalité, il instrumentalise le droit pénal pour un gain politique.
Le plus grave, c'est son mépris pour la justice. En déclarant que les procureurs et les juges "inventent une infraction", il sape l'autorité de l'État et de ses institutions. Thierno Bocoum ne fait pas une analyse juridique, il mène une campagne de déstabilisation en se drapant dans une fausse expertise.
