Réglementation : Voici pourquoi le partage de wifi est désormais sévèrement encadré au Sénégal
During a meeting with journalists from CJRS and URAC, the Director General of ARTP, Mr. Dahirou Thiam, spoke at length about the recently published press release concerning the ban on "community wifi".
Indeed, he reminded everyone, all electronic communications activities are governed by a well-defined legal framework. In other words, no entity, regardless of its sector, has the right to operate an electronic communications network without authorization. Furthermore, all sales of internet services must be regulated and must be carried out after authorization from an Internet Service Provider (ISP), in accordance with applicable regulations.
In this regard, it is important to clarify that, as a state entity responsible for applying sectoral regulations, the ARTP press release was merely recalling this principle in accordance with the provisions of Law No. 2018-28 of December 12, 2018, concerning the Electronic Communications Code and Decree No. 2022-1357 of July 7, 2022, relating to interconnection, infrastructure sharing and access.
In short, this principle doesn't just concern the use or sharing of Starlink connections; it concerns the establishment of "community Wi-Fi" regardless of the source, including Sonatel, Expresso, YaS, or any other operator. By analogy, it's worth remembering that just as water and electricity subscribers are prohibited from selling these services, the recipient of a kit or connection is also prohibited from selling it.
Consequently, anyone wishing to engage in electronic communications activities must contact ARTP for guidance regarding authorization, if required. The Director General's communication reflects this, simply reiterating the relevant legislative and regulatory provisions.
