A major turning point has occurred in the dispute between CONFISEN, owner of the "Bégué" trademark, and KKT Royal Sweets and MAAD SASU, distributors of the "ROYAL GINGERFUL" trademark. While CONFISEN had initially obtained a seizure for infringement, the courts have now reestablished the facts in favor of the Guinean and Senegalese companies, marking a significant turnaround.

According to a previously published right of reply, erroneous information had been circulating, discrediting the legality of MAAD SASU's activities. It had been claimed that "ROYAL GINGERFUL" candies were counterfeit products. However, KKT Royal Sweets has always maintained that it is the legitimate owner of the trademark "ROYAL GINGERFUL + vignette," filed and duly registered with the African Intellectual Property Organization (OAPI) under number 124381. This registration grants the company a legal and exclusive right to use its trademark in all OAPI member countries, including Senegal. Consequently, MAAD SASU, as a distributor, legally markets these products in Senegal.

The court's outcome confirms this position. In an order issued on June 23, 2025, the Dakar High Court (TGI) confirmed that KKT and MAAD SASU do indeed hold intellectual property rights to the "ROYAL GINGERFUL" trademark, authorizing them to market their products in Senegal. Consequently, the court ordered the return, subject to a penalty payment, of all "ROYAL GINGERFUL" brand products that had been seized from the distributor MAAD SASU.

According to our information, following notification of this decision, CONFISEN immediately returned the products. However, a large quantity of them was reportedly damaged during the seizure and storage. In view of this damage, KKT Royal Sweets and MAAD SASU now reserve the right to take legal action to claim compensation, including loss of earnings and damages suffered.

This case highlights the unfair and manipulative practices denounced by KKT and MAAD SASU, which aimed to tarnish their image.
