Shepherd S. Sy and taxi driver A. Niang appeared before the Thiès court for flagrant offenses on charges of conspiracy and theft. They were accused of stealing five sheep belonging to herder T. Guèye.
In court, the victim explained that he had been alerted to a broken-down vehicle at the Touba Toul roundabout, near the toll highway, transporting sheep. Once there, he stated that he recognized his five animals and found the two defendants near the vehicle. T. Guèye also specified that this was the second time he had been the victim of sheep theft.
The two men denied the accusations. A. Niang maintained that he did not know S. Sy before that day. The driver stated that Sy had simply hired him out while he was already transporting sheep for another client. According to him, a tire blew out while he was driving towards Thiès, just before they were stopped by the police.
For his part, S. Sy denied any involvement in the robbery and asserted that he had not participated in the affair "in any way, shape, or form." A man named Malick, described as his companion, reportedly fled before the police arrived.
However, the telephone records revealed regular exchanges between the two defendants before the robbery, a material element retained by the prosecution to establish their complicity.
The public prosecutor requested a reclassification of the charges against A. Niang, arguing that he had not directly participated in the theft but had made his vehicle available to the perpetrators. He therefore requested a two-year prison sentence, with four months to be served, for complicity in theft and criminal conspiracy. Regarding S. Sy, the prosecution requested that he be found guilty of theft committed by an organized group and criminal conspiracy, with a sentence of two years, one year of which would be served in prison.
Ultimately, the defendants were acquitted of the charges of criminal conspiracy. However, the judge found S. Sy guilty of theft as part of a group and sentenced him to two years in prison. As for the taxi driver, A. Niang, the court reclassified the theft as receiving stolen goods before sentencing him to four months in prison.
