Décision « scandaleuse » de la CAF : ces graves irrégularités soulevées par un expert
In the pages of L'Observateur, lawyer and professor of sports law, Moustapha Kamara, is furious about the CAF Appeals Committee's decision against Senegal. For this expert with 25 years of experience, this ruling constitutes a major legal anomaly in the history of African football. According to him, declaring a team to forfeit two months after a final – when the referee had observed nothing amiss on the day of the match – is a world first. He denounces a "very poor interpretation" of Articles 82 and 84 of the AFCON Regulations, forcefully asserting that, from a strictly legal standpoint, this decision "is unacceptable."
Mr. Kamara goes further, pointing to troubling irregularities in the Confederation's internal operations. He specifically mentions the suspicious replacement of the Director of the Legal Commission, carried out without a call for applications as required by procedure, in favor of an interim appointee who was immediately integrated into the Appeals Board. According to the source interviewed by the Groupe Futurs Médias newspaper, this appointee was allegedly "recruited for the sake of the case."
Despite this bitter reality, the lawyer places all his hope in the independence of the Court of Arbitration for Sport (CAS) in Lausanne to restore Senegal's rights. Unlike the CAF bodies, he believes that the CAS judges, through their competence and neutrality, will rigorously apply the regulations without any interference. He remains convinced that a correct interpretation of the law will ultimately "return Senegal's trophy."
