Réforme Code des investissements : Les députés interpellent le ministre Cheikh Diba sur l’éligibilité
The deputies are calling for a more inclusive and regulated Investment Code. They want to foster an "integrated or even cooperative" dynamic through the involvement of nationals in projects held by foreigners. In the presence of the Minister of Finance and Budget, the parliamentarians proposed that investment projects could last five (5) years in Thiès, just as in other regions, while estimating that lowering eligibility to 15 million CFA francs will lead to the proliferation of small and medium-sized enterprises.
They continued, arguing that the entry into force of this bill will bring about a significant change in the internal regulations of certain entities such as FONSIS. Other MPs considered that liberal and regulated professional activities are excluded from the scope of this bill, with the exception of the health sector.
Furthermore, they were also concerned about the lack of a coordinated monitoring and evaluation system that could have a significant impact on the implementation of projects and programs, or even public policies. In this regard, they wanted to know whether an evaluative study had been carried out to measure the losses in terms of tax and customs revenue due to the implementation of this new Investment Code.
Responding to the appeal by elected representatives, the minister noted that the criteria for benefiting from this Code include an investment of 15,000,000,000 CFA francs or more. "Behind this Code, there is a policy of formalizing the sector with a number of benefits such as the suspension of VAT, exemption from customs duties, etc.," he said.
Regarding the budgetary cost of implementing this Code, Cheikh Diba clarified that there was no prior analysis. However, he pointed out that an ex-post evaluation exists through the report on tax expenditures, which is a document that accompanies the draft finance law.

2)Toutefois, signale-t-il, une évaluation ex-post existe à travers le rapport sur les dépenses fiscales qui est un document qui accompagne le projet de loi de finances.
Comment peut-on faire une évaluation ex post d’un code non encore validé par l’assemblée nationale ?
Il a été ministre dans l'administration précédente qui qui est taxée de faussaire alors que lui était aux premières loges du dossier de la dette. Par ailleurs, je me rappelle que le premier mytho disait souvent qu'il était au courant de ce que ce gouvernement d'alors faisait. Est-ce lui qui le renseignait ?
les codes d'investissement sont des instruments dépassés car datant des années 1960. Les USA, l'Allemagne, la Chine, la France, le Royaume Uni, la Pologne ,etc. n'ont pas de code des investissements
