Demba Ngom, the younger brother of Farba Ngom, is beginning to see "the light at the end of the tunnel." He has been released from house arrest with an electronic monitoring bracelet by a decision of the Financial Court of Appeal. Having already been freed from his detention order last December, he now benefits from a further easing of his judicial supervision, reports Les Échos.
Initially, the newspaper reports, investigating judge Idrissa Diarra opposed the request to lift the detention order. However, the defendant's lawyers, led by Alassane Cissé, appealed this decision. They ultimately prevailed by citing "serious objections" to the charges against their client, thus overturning the investigating magistrate's ruling. Throughout the investigation, Demba Ngom denied any involvement, insisting that his activities were limited to the sub-region and that he had "nothing to do" with his brother's affairs.
This case is part of the legal proceedings against Farba Ngom, mayor of Agnam and head of the Alliance for the Republic (APR), who has been in pretrial detention since February on charges of criminal conspiracy, embezzlement of public funds, and money laundering. The case involves a colossal sum of 31 billion CFA francs, as uncovered by the National Financial Intelligence Processing Unit (CENTIF).
It was in this context that Demba Ngom was arrested in April by the Criminal Investigation Division (DIC), acting on a judicial warrant. A search of his home led to the seizure of a safe containing 100 million CFA francs. While the accused has always maintained that these funds came from his business activities, investigators suspected they were being held on behalf of his brother.
Charged with complicity in fraud and money laundering, Demba Ngom was remanded in custody at the end of April, as was his friend and co-defendant, tailor Abdou Aziz Kane. In December, after several months in detention, the two men were granted provisional release, subject to electronic monitoring.
Towards a dismissal of the case?
Since then, the proceedings have progressed favorably for both men. This decision by the Indictment Chamber comes after the one concerning Abdou Aziz Kane, who also benefited from the removal of his electronic bracelet last March. For the defense, the objective is now clear: having regained greater freedom of movement, the "final battle" will be for the dismissal of the case in order to obtain the definitive abandonment of the proceedings against Demba Ngom, the same source concludes.
