Déontologie et nouvelles obligations : Les mandataires judiciaires en formation face aux défis légaux
Senegalese court-appointed administrators are strengthening their skills to better meet the demands of their profession. During a training seminar, the president of the association of these experts, Isma Dadis Sagna, emphasized the ethical and professional dimensions of their mission, in a context marked by new legal constraints.
In his statements, he reiterated that the court-appointed administrator, as an officer of the court, plays a central role in the execution of insolvency proceedings. "Beyond that, he assumes a genuine mission of trust, serving both justice and the economy," he emphasized, highlighting the particular responsibility incumbent upon these professionals.
According to him, this mission fully justifies the strict regulation of the profession by ethical rules. It is with this in mind that the two-day seminar is being held, designed to raise awareness among members of the association about ethical requirements, but also about the increased responsibilities associated with their role.
Emphasis was also placed on the impact of new legislation, in particular Law No. 2024-08 relating to the fight against money laundering, the financing of terrorism and the proliferation of weapons of mass destruction.
A major reform which, according to Mr. Sagna, directly concerns judicial representatives, due to their position "at the crossroads of law and finance".
In the course of their duties, these professionals handle funds, which are now subject to rigorous oversight under this strengthened legislation. Hence the inclusion of this topic in the seminar program, in order to better prepare industry stakeholders for these new requirements.
As a reminder, the judicial administrator is responsible for the administration and implementation of collective procedures, which include preventive settlement, judicial reorganization and liquidation of assets.
These mechanisms, organized into preventive and curative procedures, are aimed primarily at businesses, in accordance with the provisions of the Uniform Act of the Organization for the Harmonization of Business Law in Africa (OHADA).
