Port de Dakar : une victoire qui rapporte 500 millions F CFA
The commercial court has ordered the Bamba Ndiaye SA group to pay the Port of Dakar 500 million CFA francs in damages for all causes of harm combined. This is the verdict in the civil case between the two entities concerning the construction of the Port's new headquarters. The decision was handed down on April 17, according to Libération, which broke the story.
In May 2021, the parties signed an agreement for the construction of the infrastructure for 6.49 billion CFA francs. Subsequently, the Port Authority paid half of this amount as a deposit. A little over a year later, on December 5, 2022, the two entities established an addendum outlining the payment of the remaining balance.
“To facilitate the completion of the work, the Port Authority issued a bank draft or bill of exchange for 3.245 billion CFA francs to the contractor, who committed to delivering the building in question within four months, by April 5, 2023, at the latest. But to this day, the building has still not been delivered,” reports Libération. The newspaper also notes that, denouncing this situation, “Mountaga Sy, the former Director General of the Port Authority, even filed a criminal complaint with the Dakar Urban Security Unit (SU).”
