Procédures de mise en accusation d’ex-ministres : l’expert parlementaire Alioune Souaré signale un gros «problème»
The National Assembly plans to initiate impeachment proceedings against former ministers in the coming days. Abdoulaye Diouf Sarr and Moussa Bocar Thiam are among those targeted. However, parliamentary expert Alioune Souaré has pointed out an aspect that could impact the debates. His explanation is below.
"Can the National Assembly legally examine the cases of former ministers (Abdoulaye Diouf Sarr and Moussa Bocar Thiam) prosecuted for high treason? On what basis will it proceed? Since the provisions concerning the procedure for impeachment before the High Court of Justice are no longer included in the current internal regulations, they have been struck down by the Constitutional Council (paragraphs 97 and 98; decision number 2/C/2025)!"
Certainly, the members of parliament will try to force the issue, seeking to justify themselves and invoking Article 101 of the Constitution or Organic Law 2002-10 of February 22, 2002, concerning the High Court of Justice. However, Article 62 of the same Constitution stipulates that the actions taken by the parliamentary institution must be strictly defined in its internal regulations.
Members of Parliament must understand that the rules of procedure are the sole reference and guiding principle for the soundness of their decisions! Any parliamentary initiative undertaken outside the rules of procedure can be considered null and void!
