Alioune Souaré (expert) : «Ramener à une seule fois la dissolution de l'Assemblée, un précédent dangereux !»
During a meeting of the Patriotic Alliance for Labor and Ethics (Apte), Ousmane Sonko reportedly announced his intention to initiate a reform aimed at preventing a president from dissolving the National Assembly more than once during their term. Parliamentary expert Alioune Souaré considers this a dangerous precedent. His analysis is below.
"Reducing the dissolution of the National Assembly to just one time is a dangerous precedent!"
The separation of powers enshrines the principle of the balance of powers and respect for the responsibilities assigned to each institution.
Members of Parliament jealously guard the prerogative of being able to bring down the government (motion of censure).
So why does the Prime Minister paradoxically refer to a proposed law and not a bill? Yet, the constitution designates him as one of the persons authorized to initiate legislation (art. 80)!
Surely, the initiative aims to restrict the powers of the President of the Republic!
Limiting the mandate to a single possibility of dissolving the National Assembly once creates an imbalance of power between the legislative and executive branches!
The power of dissolution is a tool to prevent and contain potential institutional crises or blockages!
Ponder this famous maxim of Montesquieu: "To prevent abuse of power, it is necessary that, by the arrangement of things, power should check power."
