Articles L29 et L30 : Le Dr Isaac Sissokho démonte le « vice fondamental » du nouveau texte
Invited to the Grand Jury program on Sunday, May 10, 2026, Dr. Isaac Sissokho, a doctor of law, approved President Bassirou Diomaye Faye's decision to request a second reading of Articles L29 and L30 of the Electoral Code. The member of the "Diomaye President" coalition believes that the head of state "could not promulgate blindly" a law of which he had received two different versions.
According to him, the president had the option of "promulgating one of the two versions at the risk of having a law tainted by a fundamental flaw" or requesting a new deliberation in the National Assembly, in accordance with Article 73 of the Constitution. "That is exactly what the Constitution provides for in this specific case," he argued.
Isaac Sissokho thus rejected the idea put forward by the Speaker of the National Assembly that it was simply a matter of transmitting the "correct version" to the Head of State. "Dialogue between institutions is governed by the Constitution," he insisted, clarifying that this was in no way a sign of distrust on the part of the President towards Parliament, but rather a "strict respect for its constitutional powers."
Regarding the substance of the text, Mr. Sissokho particularly criticized the retroactive provision introduced in the amendments to Articles L29 and L30. In his view, this retroactivity "creates legal uncertainty" and calls into question "the classic principle of non-retroactivity," which he considers an essential guarantee of the rule of law.
The member of the presidential coalition believes that an appeal to the Constitutional Council could lead to the invalidation of the text. "There is a strong chance that this text will be rejected," he declared, mentioning in particular the risks of a "dangerous precedent" for the institutional balance of the country.
