Habib Sy, Chairman of the Board of Directors of Senelec, unreservedly supports the accountability initiated by President Diomaye Faye, which he describes as the only true national consensus. Facing Omar Gningue, he argued that Senegal, across all political spectrums—the government, the opposition, civil society, and public opinion—agrees on the need to deliver justice after the excesses of the previous government. "No one can deny the immense damage caused by the previous regime," he declared, dismissing the idea of a political operation.
According to him, the revelations about fraud and embezzlement are widely shared and little contested, adding that only the courts are empowered to decide.
A “democratic revolution” framed by the rule of law
This implies scrupulous respect for procedures, legal forms and republican institutions, in particular the independence of the judiciary, a fundamental principle of the rule of law.
Justice: against the temptation of victors' justice
The former minister sought to reassure President Diomaye and the Prime Minister about the possible instrumentalization of the justice system. According to him, the current regime respects the separation of powers. "They do not interfere in the functioning of the justice system," he said, citing the recent release of Mansour Faye as an example, which, he said, illustrates the absence of political score-settling.
Habib Sy reiterated that the need for justice is legitimate, but must be achieved without excesses. "No two-tier justice or victor's justice," he insisted, referring to the recent decision of the Constitutional Council, which rejected an attempt by the National Assembly to issue injunctions to the judiciary.
Popular control of justice under debate
While defending the independence of the judiciary, Habib Sy nevertheless raised an important question: "The people have no power over the judiciary, while justice is rendered in their name."
He thus proposes the creation of a citizen control body, composed of academics and representatives of working-class communities, such as peasants and farmers. This proposal is part of the dynamic of ongoing reforms, particularly those affecting the Penal Code and the Code of Criminal Procedure.
