«Je n’y retournerai pas…» : Barthélémy Dias clôt le débat
The latest reform of the electoral code sparked a debate about a possible return of Barthélémy Dias to the mayor's office in Dakar. However, the former mayor clarified that he is not interested. "If the law is enacted, it doesn't concern me. If it is retroactive, I will not return to the Dakar mayor's office. I will not return to the National Assembly," he stated on 7TV.
He continued: "My dignity does not allow it. It was votes that led me to the mayoralty of Dakar. I was forcibly removed from it, but I will not use any tricks to return. Whether the law is retroactive or not," stated the leader of the "Sénégal Biñu Bok" movement.
Given the principle of retroactivity of the law amending the electoral code, particularly articles L29 and L30, some legal experts have pointed out that the reform could directly apply to Barthélémy Dias. They explain that the former mayor of Dakar, removed from office and replaced by Abass Fall, had the murder charges reduced to manslaughter (a lesser offense).
He is therefore not subject to the articles of the General Code of Local Authorities concerning crimes or embezzlement of public funds, stated legal expert Dr. Aldiouma Touré, interviewed by Walf. Consequently, to dismiss him, the State had to resort to Article L29 of the Electoral Code. Therefore, the expert believes that "the general and impersonal nature of the rule of law prohibits preventing Barth from benefiting from this law, which was expressly declared retroactive."
