Professor Ousseynou Bâ, a lecturer and researcher in criminal law at UCAD, is adamant: Macky Sall, whose return to Senegal is causing controversy, can set foot on national soil without fear of legal repercussions. "There is no risk. If he is prosecuted, what offense will he be prosecuted for?" he asks in an interview with L'Observateur.
Professor Bâ is even convinced that "when Macky Sall comes to Senegal, he will be welcomed as a hero." "That, I am certain of," he proclaims before continuing: "No legal proceedings can be initiated against the former president of the Republic because the only charges against him are high treason. What behavior by Macky Sall would be considered high treason? We are told about hidden debts, but Ousmane Sonko says he didn't have all the necessary information when he spoke."
Can the former head of state then be prosecuted for crimes against humanity, in reference to the bloody events of 2021-2023? “The events have been amnestied,” thunders the professor at UCAD. “The law wasn’t repealed because they wanted to protect certain people by limiting its scope. The Constitutional Council declared this law unconstitutional and rejected it. So, since the events have been amnestied, what offense will they prosecute for? I don’t see any. And if they invent something, the judges will make them understand that it’s ridiculous.”
