Réforme institutionnelle : le Président de la République ne peut plus diriger un parti politique
The draft constitutional revision bill introduces a major change to the status of the head of state, who is now formally excluded from any leadership role within a political party or coalition.
According to Article 38 of the text, the office of President of the Republic is incompatible with membership in any national or local elected assembly, as well as with holding any other public or private office. It also prohibits the Head of State from leading a political party or a coalition of political parties, their role within a political organization being strictly limited to an honorary function.
The text further specifies that the President of the Republic may not participate in an election campaign unless he is himself a candidate for re-election. He nevertheless retains the possibility of being a member of academies in various fields of knowledge.
According to Article 39, "in the event of the resignation, permanent incapacity or death of the President of the Republic, the replacement is ensured by the President of the National Assembly. The latter is responsible for organizing the presidential election within a minimum period of sixty days and a maximum period of ninety days, after the finding and announcement of the vacancy by the Constitutional Court".
When the President of the National Assembly is himself in one of the cases of impediment referred to, the substitute is ensured by the first Vice-President of the National Assembly, and, if the latter is impeded, by one of the other Vice-Presidents according to the established order of precedence.
