Révision constitutionnelle : La riposte de Pastef suite au recours du Pr. Diomaye
As announced earlier on Tuesday, the President of the Republic has filed a constitutional challenge with the Constitutional Council, alleging unconstitutionality "for violation of the constitutional revision procedure of Law No. 18/2026 of the National Assembly, dated June 29, 2026." The Pastef party members of parliament, who authored the proposed constitutional revision, have responded.
In their statement released late Tuesday night, Ayib Daffé, Abdoulaye Tall, Fatma Mbodj, Abdoulaye Sow, Awa Sonko and Anne Marie Yacine Tine declare that this is yet another betrayal by the President of the Republic, Bassirou Diomaye Diakhar Faye.
"While he officially indicated, in his written response to the request for an opinion from the President of the National Assembly, reiterated by the Minister of Justice before the national representation, his intention to submit the text to a referendum, the President of the Republic has gone back on his word to refer the matter to the Constitutional Council in order to invalidate the entire text," they say.
For these deputies, by this appeal, Professor Diomaye admits that the text is definitively approved, "in accordance with the constant jurisprudence of the Constitutional Council, which considers that adoption by three-fifths of the votes cast achieves both adoption and approval."
Also, these members of the Pastef parliamentary group believe that the President of the Republic can only refer a constitutional revision law to the Constitutional Council when the various stages of the procedure are definitively completed.
"It also follows that, contrary to his commitment, he is definitively burying the arbitration of the sovereign people by calling a referendum, which he is avoiding in order to prevent a predictable and crushing electoral debacle," they say.
Therefore, the proponents of the constitutional revision proposal say they are convinced that, given "the extreme legal weakness of the means developed by the President of the Republic in his appeal, the Constitutional Council, whose decisions are binding on all, will reject it and thus open the final stage of its promulgation."
